All monetary collections will be made directly through PayPal*, and not to or through photags.com. Hence it will be necessary for PhoTags users and their paying Customers to open PayPal accounts, and be subject to the applicable PayPal Terms of Use. PhoTags, Inc. a Smith Micro Software, Inc. Company is not affiliated with PayPal, and neither is the agent or employee of the other, and neither is responsible in any way for the actions or performance (or lack thereof) of the other. To the extent that any Service provided hereunder is rendered in conjunction with any other provider of services, the same shall also be true, namely that to the extent that a user of Services hereunder does so in conjunction with the services of another service provider, such user will be subject to the other service providers terms of service, and neither PhoTags, Inc. a Smith Micro Software, Inc. Company or the other service provider will be considered the agent or employee of the other, and neither will be responsible in any way for the actions or performance (or lack thereof) of the other. The terms of this agreement shall not in any way supersede the terms of any other service provider, nor shall the terms of service of any other service provider supersede the terms of this agreement with respect to the Services.

If PhoTags, Inc. a Smith Micro Software, Inc. Company does not receive payment from the card issuer, you agree to pay PhoTags, Inc. a Smith Micro Software, Inc. Company all amounts due upon demand. PhoTags, Inc. a Smith Micro Software, Inc. Company may take commercially reasonable actions to validate your credit card and collect all payments due. You agree to pay all attorney and collection fees arising from any efforts to collect any past due amounts from you to the extent allowed by law. You understand that if PhoTags, Inc. a Smith Micro Software, Inc. Company does not receive timely payment of all amounts due for any Service you purchase, your use of any PhoTags, Inc. a Smith Micro Software, Inc. Company Service may be severely restricted or terminated at PhoTags sole discretion. This includes any Information you provide to PhoTags while using any PhoTags Service.

THE FEE FOR ANY PHOTAGS, INC. A SMITH MICRO SOFTWARE, INC. COMPANY SERVICE IS NONREFUNDABLE. PHOTAGS, INC. A SMITH MICRO SOFTWARE, INC. COMPANY WILL NOT REFUND ANY FEES PAID BY YOU IF YOU TERMINATE YOUR AGREEMENT WITH US.

(b) PhoTags, Inc. a Smith Micro Software, Inc. Company reserves the right at its sole discretion and as it deems appropriate to change its fees for any product.

(c) You agree to notify PhoTags, Inc. a Smith Micro Software, Inc. Company immediately if you suspect unauthorized use of any PhoTags product.

(d) You agree to pay any taxes, including personal property taxes or sales taxes, resulting from purchasing the PhoTags product. You agree to pay all attorney and collection fees arising from our efforts to collect any past due amounts from you to the extent allowed by law.
